The House Projects Thread
Re: The House Projects Thread
Also a question to add, does any of the new renters rights act come into this with it being a freehold/leasehold situation?

Re: The House Projects Thread
The court should have a file on them with private notes from previous judges which should be extremely daming by this point - which should also prepare the judge for the onslaught of BS they're going to hear. In fact, a hearing was carried out very recently in our absence, because we hadn't been notified. The neighbours claimed they had gone to the courts to pay for the application and it's as if a judge saw their application, pulled them in simply to quickly dismiss it.
The new renters rights stuff doesn't impact this luckily!

Re: The House Projects Thread
Today went really well, we got over 2 hours with a judge who was extremely patient, thorough and went to great lenghts to understand the entire history fo the case, and was determined to hear every last argument from my neighbours, to ensure everything was wrapped up.
The hearing was for a new claim (an attempt to circumvent the previous claim which they'd lost), and there were three other applications they'd submitted on top of that. After allowing the other side to talk at great lengths and present all of their grievances, including an array of utterly scandalous lies about my conduct, the judge made it very clear they'd been abusing the courts process, they'd been using the courts to harass and vex me, and then threw out the claim as totally without merit, plus went on to dismiss all of the other applications, two of which as totally without merit too.
He didn't go as far as the civil restraining order on the basis that we only had one totally without merit prior to today. However, his actions today ensure that if my neighours attempt anything else in the courts without solid grounds, we'll be straight to the high court for an extended civil restraining order and likely get it too.
It's a great outcome, it's everything we could hope for, and now I'm going to lay down for a while

That's good news. Surely this must be wrapped up soon.

Sounds about everything you could have realistically hoped for. Great stuff
Re: The House Projects Thread
That sounds a lot more positive - I'm no Simon J Jobson, Legal Beagle Esquire, but that sounds very much like the judge rolling his eyes so hard it affected the rotation of the earth, and telling them to get right to fuck, but in procedural legalese.
About time, frankly.

Re: The House Projects Thread
That sounds like another win today, but do you yet have the possession order to kick them out? i.e. is it over, barring any more spurious applications or attempts to appeal by them?

Re: The House Projects Thread
We got the possession order (with terms of relief) last year, and I also have a warrant for possession with bailiffs due to attned next week. So yes, we're very, very, very close to it all being completely overJobbo wrote: Tue Jun 16, 2026 4:58 pm That sounds like another win today, but do you yet have the possession order to kick them out? i.e. is it over, barring any more spurious applications or attempts to appeal by them?

That's great news. If I'm honest though it is another part of the system that puzzles me - i.e. that the person who would hear this is someone completely new without the background of the case.Gavster wrote: Tue Jun 16, 2026 4:06 pm Today went really well, we got over 2 hours with a judge who was extremely patient, thorough and went to great lenghts to understand the entire history fo the case, and was determined to hear every last argument from my neighbours, to ensure everything was wrapped up.
I guess if the judge you'd seen previously was wrapped up on a 9 month trial then this has to be the way it is done otherwise your next court date could be months and months away. It does seem awfully inefficient however.

It's a good point, it is crazy how many judges we've been through and never the same one twice. When a case has history like this, it would be amazing to have the same judge who would also tire far quicker of all the BS. All credit to the guy today, he absolutely zoned-in to precisely what needed to be addressed and managed to get his head around the entire case from start to finish very quickly and summarise it.

This is the bit that baffles me. How many last minute goes do they get?!Gavster wrote: Tue Jun 16, 2026 5:36 pm They could submit a last minute application to stay the warrant, although the chances of success are very low and at worst would only result in a postponement of possession.
