Are you saying that in Hong Kong, if the buyer pulls out, they lose their deposit but of the Seller pulls out, they have to return the deposit plus 5%
I'm doing a bad job explaining but in basic terms yes.
How about not having a sig at all?

On the subject of pulling out of sales, I've always loved how my dad gave a bras d'honneur to a buyer who tried to gazunder him when selling my grandparents' old flat. The guy buying was a cash investor, but had been cocky, giving us the runaround with delays and drove a really hard bargain too. Nonetheless, the flat needed to be sold so he got a deal done. On the week of exchange, the buyer decided to gazunder us and dropped his offer. Instead of capitulating my dad cancelled the entire sale and walked away.

The buyer, who'd been very cocky and confident until this point came back desperately grovelling, offering all kinds of things to get the sale back, in cluding paying more money. He was clearly desperate to make the sale go through. My dad simply told him to get fucked and walked away. Ended up selling it to someone who actually wanted the place :D

A mate of my brother's did exactly the same. Selling in London to move home to New Zealand. Their estate agent lets this slip to the buyer. The day before the exchange (with their entire life either in storage or already on the way to New Zealand in a container) the buyer lower their offer by £20k. Tim similarly told them to get fucked... and again, refused to do business with them even when they tried to up their offer.
