The diver chap doesn't have to commence proceedings within mere days. According to the papers yesterday he is already bringing proceedings but if he weren't, Musk bringing it up again would no doubt cause him to. Idiot.
Even if the allegation were true, Musk almost certainly won't have any evidence to prove he knew or had an honest belief that it was true when he tweeted. And he's the one who has to prove it's true. He's just an utter idiot.

Even if Musk had solid evidence the allegations are potentially true then the diver dude would have to go through a fair trial for that to even stick. Even then, at the time Musk tweeted the comments, he wasn't even alleged to have done anything opalong those lines let alone be convicted.
