Selling my Dads Car?
The inevitable happened last week and my dad passed away after a long hospital stay and conclusion to his long illness. We have now been left with the logistics of tidying up the things he hadn't pre-planned, which there aren't many as he was given the news back in April so organised as he was he'd sorted nearly everything.
The large thing he didn't resolve was his car mainly because he was still driving infrequently up until a few weeks ago. Mum won't drive it and it's just sat there depreciating gathering green moss now. The question is can I just sell it on behalf of my mum or do i have to wait for probate to be granted? Looking at WBAC they say as the value is over 10k they cannot buy without probate. However does this apply to a private sale? My dads will is open and shut with everything being passed to mum and some gifts for the kids. There won't be any contest, so my guess is who is to know if it goes privately, after all the money will go into their joint bank account.
I just wanted to remove the burden of having it on the drive as it just serves as a reminder and it's one of the little things I can do to help.

I'd just apply some common sense and ignore the law. Advertise it and sell as a normal private sale.

As long as there is no finance outstanding on the car and you do the reg transfer online id tend to agree with Ste.

Car wise, No finance, paid for it cash 18 months ago new from the dealer.
I was going to sell it privately.
I guess the WBAC etc will have to add on the legal bits so they don't get caught out, it just made me wonder as it's part of their jargon.

Selling it from its V5 address may be worth a try. Ask DVLA or HMRC?. They’ll probably have some procedure.

I can’t be of any help but sorry for your loss.
We’ve been through three deaths in the last twelve months and just finished settling the affairs of the last one, all I can say is remeber to look after yourselves as it can be a surprisingly difficult time for all involved.
