Item went missing with shipping company turns up on eBay
Item went missing with shipping company turns up on eBay
I sold a Rotel amplifier on eBay a few months ago, stupidly shipped it with Hermes (needed to post it at short notice and they have a drop off 30 seconds from my office in London), and it went missing.
Item sold for just under £300. Got £50 back from Hermes because it took them 2 weeks to confirm it was missing ( I hadn’t taken out any cover)
It’s turned up on eBay today with a London based seller that doesn’t have much history, so it doesn’t look like part of a job lost of undelivered packages that the couriers offload from time time.
Do I have any claim to the amp?
I asked the seller how long he’d had it for, if all channels were working and where I could collect it from and he replied that it was only available for postage and all channels were working, not answering the ownership time query.

Is it the A11 Tribute up for £325? How do you know it is definitely your missing amp and do you have any proof, such as the receipt and serial number?

Joe Lycett did a thing about how masses of Hermes parcels are/were being sold through trade auctions - while still fully labelled and addressed. They bought a few items and returned them to their owners. Surely this is some kind of theft?

I have a date stamped photo of the serial number and the mark on the front where I removed a label. No receipt as it came out of an AV rack that I stripped down for a client.

Without any proof of ownership you’re going to struggle.

Is it even still yours if Hermes have paid out on it ? Like insurance on a car that's stolen, paid out, and subsequently recovered.

I think it would be - Hermes have paid compensation for losing it, but not thereby taken ownership. If someone broke your laptop and paid you for a new one, they wouldn’t own the broken one - that’s specific to the contract of insurance with your own insurer. I’m not sure if Hermes’ T&Cs purport to make them insurer.Sundayjumper wrote: Sun Aug 28, 2022 10:50 am Is it even still yours if Hermes have paid out on it ? From a quick look on their website, they do refer to "compensation" rather than "insurance".
As an aside, their list of things that are excluded from compensation is quite extensive and worth reading.

Do you think it’s worth me asking them to post it to me, otherwise I’ll report it?

Literally "Don't send anything valuable with us"
Re: Item went missing with shipping company turns up on eBay
Pillows should be their limit looking at that list!

Buy it on PayPal then claim it never turned up…
Cheers, Harry

No because you have no proof that you own it. A photo of the serial number isn’t proof of ownership.

I’ve got dialogue with him, even though he’s pulled the sale.
He say that he bought it from gumtree two weeks ago, and it needed fixing so he’s fixed it. He has asked me to prove that I own it.
Let’s see…
