Sounds like it's more procedural than on merits:
I'm sure some of the more legal minded types can pull that apart in more detail but it sounds like Geico didn't do the right paperwork/procedures to avoid this outcome, which is a bit concerning given that you'd hope a big insurance company would be moderately competent at this stuff for thier own sake of nothing else
They didn't interact with the case and properly defend themselves/thier customer, and the latter appeal court is just confirming that means they'd need to find a different way to appeal?Geico appealed the judgement. But on Tuesday, a three-judge panel confirmed the lower court's ruling and said the insurance company failed to defend its own interests by entering a defense of the insured man.
"Geico did not take advantage of this opportunity, and instead denied coverage and refused to defend Insured," the opinion said.
