Didn't you get the X5 to tow the race car? Is there another plan for achieving that?

Yes. I’m going to be doing less racing this year. Spent too much doing it last year. There was more money going out that coming in when I was racing. That’s not sustainable. I might do some more racing later in the year. I could fit a tow bar to an estate car and there’s a local place that rents smaller trailers. The trailer I was using belongs to our mate Ross and it’s lovely but massive. I don’t really have anywhere to store it either other than parking it on the shared private road we live up - Which my neighbour’s were fine with but it’s not ideal.

In that case I'd be angling for a full refund on the X5, buy something cheaper and put the spare cash towards the racing.

Ive put 14000 miles on the X5 so they are entitled to reduce what they give me based on the time ive had it and the mileage. Ive read up on the sale goods act regarding refunds. Will see what they ay later today. I took it on Finance as i didnt know what the car market was going to do at the time. I put £6000 equity from the 318d into it so hopefully i can get most of that back. Will see what they say when I take the GC back today and speak to them.

14k miles ! OK, that makes a difference. But still the onus is on them to repair or replace and they've already failed on the repair side. If they can't replace - with something acceptable to you - then return/refund is the only option remaining.

Have you asked the finance company about this ? They might have some leverage on the dealer in cases like this if it's *technically* their car until it's paid off.

Yes. I’ve got details on their complaints procedure. Hopefully we can sort something out that works without going down that route.

Well that was a waste of time - their offer was to pay off the finance and leave me zero'd out.

Ive unsurprisingly said no to that and im going to raise a formal complaint.

No. It’s a complaint directly to bmw. This is the process. They say you should raise issues with the dealer in the first instance. If you are not happy with the outcome of that then you raise it with BMW directly. I have a friend who works with bmw HQ. He said email him with details and he’ll pass it on to one of his contacts internally.

AC are famously crap with anything to do with complaints, but you'd expect such a new car to be fault free so you get the benefit of the cheaper price from them without having to deal with their customer "service" team.

I once got a letter from their HO saying "we know you are right but we are not prepared to do anything, whatcha gonna do about it?" I have slightly misquoted but the gist is there.

I hope you get more joy through BMW.

No. It was bought through Harry Fairbairn approved BMW. They have recently rebranded to Arnold Clark but it’s a bmw approved car.
