I've had clients say their demolition has been delayed for a year due to missing the bat survey window - it sticks in the mind :lol:
Have found other advice that says Phase 2 surveys must be between May-September and there must be at least three spaced-out surveys; and if there is evidence of activity or high potential then the end of August is the deadline for the majority of them. Start as early as you can; you're in time for this year's window of opportunity :lol:

I guess so! Although it's a rural barn, so I'd say the chances of it having bats in it are pretty high. I've not read all the guidance as there's not much I can do about it - i.e. unless there's some massive bat colony or some super rare make of bat in it, can we just say we'll stick some bat boxes up when we're done and we're golden?

Almost certainly - what is stupid is that the bat survey is still a necessity even if you plan for bats being there and give them a replacement roost.

We’ve got the same judge again for the hearing tomorrow, which puts us in the best position to get an order. He was brilliant last week and we’ve been allocated marginally more time tomorrow, so keeping all my fingers and toes crossed. Counsel is quite excited 😂

That's an interesting time to start - I guess it had to be squeezed in after the unplanned adjournment but the judge clearly does not expect it to take too long.

There’s no hearings after us, which means the judge should have time to hear out every spurious argument that my neighbours might have, until the only outcome is making an order 🤞

Only just got out. The judge went to great lengths to hear out any substantive defence and put up with a lot of nonsense. Unfortunately the judge decided that he was not able to fully dispense with all 84 pages of the defense in the time available and that it needs to be referred to a circuit judge, which is the next tier up.

So it’s been pushed onto another court and we can expect a 3 hour hearing towards the end of the year. The only upside is that the next judge will inevitably go to great lengths to ensure all and every defence is heard and dismissed.

Sigh 😞

That's very annoying. I mean "later in the year" should not be acceptable timing for a follow up hearing - the court system really doesn't work does it.

It feels like the judge lost his nerve when he realised he was going to have to make a possession order. It was all going well until around halfway through when he started saying that he simply didn’t have enough knowledge and that it is “above his pay grade”. Very annoying especially given how decisive he was last week. Being told to expect a 6 to 7 month wait for a hearing now. At least this means we’re almost certainly going to get an order at the next hearing, barring any freak occurrence
